📘 General Terms and Conditions (GTC-B2C)
of Pull Up Case GmbH for orders via www.pullupcase.com
1. Scope
These General Terms and Conditions (GTC) of Pull Up Case GmbH apply to all contracts that consumers conclude via the online shop www.pullupcase.com conclude. Deviating conditions of the customer are not recognized unless the seller expressly agrees to their validity.
2. Conclusion of contract
The products displayed in the online shop do not constitute a legally binding offer but an invitation to submit an order by the customer.
By submitting the order, the customer makes a binding offer to conclude a purchase contract. The contract is concluded when the seller accepts the offer within five days by sending an order confirmation via email or by delivering the goods.
3. Right of withdrawal
Consumers have a statutory right of withdrawal.

The right of withdrawal does not apply to customers with exclusive residence and delivery address outside the European Union.
4. Prices and payment terms
All prices are final prices and include the statutory value-added tax.
Shipping costs are shown separately during the ordering process.
For deliveries outside the EU, additional costs (e.g., customs duties, taxes, or fees) may be incurred, which must be borne by the customer.
The payment methods offered in the online shop are displayed during the ordering process.
5. Delivery and Shipping
Delivery is made to the delivery address specified by the customer.
The delivery times are indicated for the respective products.
If delivery fails for reasons attributable to the customer, the customer bears the resulting additional costs.
For entrepreneurs, the risk of accidental loss passes to the customer upon handover to the shipping company. For consumers, only upon delivery of the goods.
6. Retention of title
The goods remain the property of Pull Up Case GmbH until full payment is made.
7. Liability for defects (warranty)
The statutory warranty law applies.
For entrepreneurs, the limitation period for claims for defects is one year from delivery of the goods. This shortening does not apply in cases of intent, gross negligence, or claims due to injury to life, body, or health.
8. Vouchers
Promotional vouchers can only be redeemed during the specified period and only once per order. Cash payment or subsequent crediting is excluded.
The resale of promotional vouchers is not permitted.
9. Applicable law
German law applies excluding the UN Sales Convention.
This choice of law applies to consumers only insofar as it does not deprive them of protection by mandatory provisions of the state of the consumer's habitual residence.
10. Place of jurisdiction
For disputes with entrepreneurs, the place of jurisdiction is the seller's registered office. For consumers, the statutory regulations apply.
11. Online dispute resolution
The seller does not participate in a dispute resolution procedure before a consumer arbitration board.
